Edo Officials Risk Jail Over Alleged Land Grab of 200-Hectres Benin Property

Top Edo State officials, including the Attorney-General and Commissioner for Justice, could be sent to prison following allegations of defying a High Court judgment over a sprawling 200-hectare land in Benin City.

The court has served a Form 49 - a notice demanding reasons why the officials should not be jailed for contempt on the Attorney-General, the Commissioner for Lands and Housing, the General Manager of the Edo Geographical Information Service (EDOGIS), and Dr Abdulwashiu Oyakhire, Secretary of the Edo Lands Restitution Committee.

The notice stems from Suit No. B/672/2023 filed by Mayer Uyiekpen Ologbosere and Portcall International Farms Limited, who claim ownership of the Obagie Nevbuosa village land, registered under Certificate of Occupancy No. EDSR 14764.

Court records show that a consent judgment delivered on 3 March 2025 by Justice Imadogbelo awarded the land to Ologbosere and Portcall Farms. 

The judgment followed a settlement agreement reached in court, with the Attorney-General present through legal representation.

Despite the ruling, the applicants allege that the government officials and agencies have ignored the court order, encroaching on the land and allegedly distributing portions to third parties. 

The affidavit supporting the Form 49 describes these acts as a blatant contempt of court.

All the named officials have been formally served with the notice, and failure to provide a satisfactory explanation could see them committed to prison, underscoring the judiciary’s resolve to enforce its rulings and protect property rights.
