Court affirms Ologbosere’s ownership of 200 hectares in Edo, voids others’ certificates
BENIN CITY - The Edo State High Court sitting in Benin City, presided over by Justice Geraldine Imadegbelo, has delivered a consent judgment confirming the ownership rights of Uyiekpen Ologbosere and Portcall International Farms Limited over 200.309 hectares of land in Obagie-Nevbosa, Ikpoba-Okha Local Government Area of Edo State.
The case, filed as Suit No. B/672/2023: Uyiekpen Ologbosere and Portcall International Farms Ltd versus The Governor of Edo State and 20 others, culminated in a ruling that set aside all Certificates of Occupancy (C-of-O) earlier issued by the Governor in favour of other individuals.
The court upheld the validity of the C-of-O granted to Ologbosere and his company over the entire expanse of the disputed land.
Justice Imadegbelo also granted a perpetual injunction restraining the Edo State Government, its agents, or any persons claiming through them from trespassing or interfering with the property, as described in Survey Plan No. SEA/ED/97, bordered pink and attached to C-of-O No. EDSR 14764.
The judgment further authorized the claimants to take full possession of the land and remove any illegal occupants. However, the court declined to award monetary compensation.
By the ruling implies, any individual or group who encroaches on the property henceforth would be in contempt of court and liable to imprisonment.
