Court issues 2-week ultimatum for occupants to vacate land in Evbukhu
BENIN CITY – The Benin High Court has issued a two-week ultimatum, effective from 4 April 2025, for all current occupants to vacate a parcel of land situated at Evbukhu in Oredo Local Government Area of Edo State.
The directive comes following a judgement in favour of Mr Frank Omo Amadasun, who has been declared the lawful owner of the land measuring 200 feet by 300 feet.
The judgement, delivered by Honourable Justice M.E. Itsueli, affirms that Mr Amadasun is entitled to take full possession of the property after the court adopted a previously reached settlement as a consent judgement.
The settlement, initially agreed upon by the parties at the Edo State Private Property Protection Committee and later ratified at the Edo State Multi-Door Courthouse on 10 July 2024, confirmed Mr Amadasun’s ownership of the land and required the respondent to remove all encroachments.
The parcel of land, described in Survey Plan Number ASE/ED/338/2011, had reportedly been encroached upon by an unidentified individual, prompting Mr Amadasun to petition the Edo State Property Protection Committee.
Following the petition, the Amagba Iduwe Akengbuda community agreed that the matter be referred to the Multi-Door Courthouse for formal resolution.
The court has now issued a certificate of execution of warrant of possession, under general title “A” and form number ESMDC 38/WP/2024, signed by M.O. Okoeguale. The document is to be enforced immediately, with all parties—including their heirs, assigns, executors, personal representatives, and successors in title—legally bound by the court’s resolution.
With the issuance of this certificate and the court’s judgement, Mr Frank Omo Amadasun is set to take full control of the property, and all unauthorised occupants are required to vacate the land without delay.
